1. Scope of services
We provide photography and videography services such as wedding coverage, pre-wedding shoots, portraits, events, cinematic storytelling, album design, and final media delivery. The precise scope, timeline, pricing, and deliverables will be detailed in the final quotation, booking form, or signed agreement.
2. Booking confirmation and payment
- All bookings require a confirmation deposit or advance payment to reserve the date and time.
- The final balance must be paid as specified in the invoice or booking agreement.
- Payments are considered confirmed only after receipt of the agreed amount and issuance of confirmation by the studio.
- Any applicable GST or statutory taxes will be charged as per Indian law unless clearly stated otherwise.
- We reserve the right to cancel or rebook a session if the payment terms are not met within the agreed timeline.
3. Rescheduling, cancellation, and refunds
If an event is rescheduled, we will make every reasonable effort to accommodate the new date according to availability. Cancellation terms will depend on the notice period and work already committed to the booking.
- Late cancellations may result in forfeiture of the advance payment or a partial cancellation fee.
- Rescheduling requests must be communicated in writing and are subject to availability and revised pricing if needed.
- Refunds are processed only where legally applicable and subject to the agreed cancellation policy.
4. Service timing and coverage
We endeavour to arrive on schedule and provide the agreed coverage. Actual coverage may be affected by travel conditions, venue restrictions, weather, crowd movement, technical issues, or other factors beyond our control.
- Coverage hours and team size are based on the agreed package and quoted schedule.
- Extended service beyond the booked time may be charged separately.
- We are not liable for incomplete coverage caused by restrictions or circumstances outside our reasonable control.
5. Client responsibilities
- Clients must provide accurate event details, preferred timings, venue information, and special creative guidance.
- Clients are responsible for obtaining venue permissions, access approvals, and any local permits required for photography or videography.
- Clients must communicate any objections, family concerns, or restrictions before or during the shoot so we can make reasonable adjustments.
- We are not responsible for missed moments caused by uncooperative conditions, poor lighting, crowd movement, or other venue-related issues.
6. Delivery timeline and final media
We will make every effort to deliver the final edited photographs and videos within the agreed timeframe. The exact delivery period may vary according to project volume, editing complexity, and client feedback cycles.
- Final media is delivered through online galleries, downloadable links, or other agreed channels.
- We are not responsible for delays caused by network conditions, external storage issues, client feedback delays, or accidents beyond our direct control.
- Clients are expected to review and provide feedback within a reasonable timeframe to avoid extra delays.
7. Copyright, ownership, and usage rights
Unless otherwise agreed in writing, the creative work produced for the client remains the intellectual property of Shiv Shakti Visuals. We grant the client a personal-use license for the delivered photographs and videos as specified in the booking agreement.
- Clients may use the final images and videos for personal, non-commercial purposes unless otherwise specified.
- Commercial use, public posting, publication, advertising, or third-party distribution requires prior written consent.
- We may use selected work in our portfolio, website, or social media channels when permitted by the client and consistent with the booking arrangement.
8. Travel, accommodation, and additional charges
Certain assignments may require travel, accommodation, parking, tolls, permits, or local transport. These charges may be added separately if not explicitly included in the original quotation.
- Additional travel or waiting time beyond the agreed schedule may be billed separately.
- Outstation assignments may be subject to prior written confirmation and revised estimates.
9. Privacy and data protection
We will handle your personal information in accordance with our Privacy Policy and applicable privacy laws. We will only use your data to fulfil the booking, deliver the service, maintain records, and communicate with you regarding your event.
We respect the confidential nature of event media and will not share private photographs or videos outside the internal team without your consent unless required by law.
10. Limitation of liability
Our liability for any claim arising out of our services is limited to the fees paid for the booking, subject to the applicable law. We shall not be liable for indirect, incidental, consequential, or emotional damages, including loss of memories, reputational impact, or business interruption, unless such liability cannot be excluded by law.
11. Governing law
These Terms & Conditions are governed by the laws of India. Any disputes arising out of or in connection with the services shall be subject to the exclusive jurisdiction of the competent courts in India, unless otherwise required by law.
